Terms & Conditions
- The Tour Operator is Intibane Bike Tours (Pty) Ltd, registration number: 2015/318142/07 (referred to after this as IBT). 37, Frangipani Crescent, Randpark Ridge Ext. 41, Randburg 2125, Gauteng/RSA. Place of jurisdiction: Randburg, South Africa.
- Aside from the services directly rendered by IBT, a variety of touristic services are arranged with other parties (accommodation, transport services, activities), in which case IBT acts as an agent and subsequently these third party services formulate part of this contract. Conditions of such third party service providers (i.e. safari operators, bus tour operators, airlines) prevail.
- On receipt of a written booking confirmation, the client accepts these Terms and Conditions. Any changes of these require the consent of both parties in writing. The notice period of any changes is thirty days before the start of the event. Verbal changes are not valid unless confirmed in writing by IBT.
- The onus is on the client to adhere to international travelling requirements, such as a valid passport, visa and health requirements and to comply with foreign currency and customs regulations.
- Every participant of an IBT tour will be required to sign an indemnity and disclaimer before the start of the tour.
- To secure a booking of the tour, a deposit of 20% is required, with the balance of the tour cost to be settled 45 days before the tour starts. Should the balance payment not be received 45 days prior to tour begin, IBT retains the right to consider the booking cancelled and charge a cancellation fee of 20%, less than 45 days but more than 20 days prior to departure a cancellation fee of 30%, less than 20 days prior to departure a cancellation fee of 100%.
- A safety deposit is required before the tour starts, usually equally to the insurance excess of the chosen vehicle. This safety deposit will be refunded upon the return of the undamaged motorcycle. Should the client not be able to ride the motorcycle for reasons of incapability, the agreed rental period is not interrupted. There is no obligation on IBT to replace a damaged motorcycle due to rider error.
- In case of unforeseeable cancellation by IBT due to force majeure and/or exceptional circumstances which cannot be avoided despite exercising due care during planning, the deposit will be refunded to the client (i.e. natural disasters, epidemics, strikes, riots, war etc.)
- Should any of the motorcycles be subject to a mechanical breakdown, IBT commits to replace that motorcycle with a model of the same type. Should this for reasons beyond IBT’s control not be possible, IBT will refund the difference of the motorcycle category’s rates.
- The tour price includes everything mentioned for the particulars arranged in writing. Anything not specifically confirmed, is excluded.
- IBT assumes no responsibility for loss, damage or delay in delivering luggage to tour participants. Any luggage is transported and stored at the owner’s risk. It is advisable to take specific insurance cover for luggage, particularly items of high value (i.e. computers, cell phones, jewellery etc.)
- It is advised that the customer familiarises himself with the traffic laws prevailing in the country of travelling. IBT retains the right to terminate a tour should the participant not adhere to these laws. Riding under the influence of alcohol or drugs (including medication which affects the reaction of the rider) is strictly forbidden and will result in the summary cancellation of the booking and the customer will be obliged to return the motorcycle to IBT.
- IBT responsibility. IBT undertakes to provide the services agreed upon in a professional way, to fulfil the standards expected to the level as described in its media. Third party contractors are carefully chosen and regularly checked, such as hotels, bed and breakfasts, lodges, restaurants. Any claims due to omission of one of the aforesaid have to be lodged with such service provider. IBT takes responsibility of the careful selection of these service providers. IBT is not responsible or liable for any accidents and reserves the right without prior notice to withdraw any part or all of a tour. In such a case, if applicable, the extra costs for any changes resulting therefrom, shall be paid by the customer. IBT are not the guardians of any customer’s safety and they cannot be held liable in any way for any occurrence in connection with the operation or the client’s participation in the tour, which may result in injury, death or other damage to the customer, his property, or his family, heirs or assigns. IBT is not responsible for any delays, changes in schedule or other conditions.
- Depending on the areas visited during the tour, weather conditions can alter very fast and substantially. IBT cannot held liable for changing weather conditions and any potential changes of the schedules of the tour.
- It is advisable that the client takes out personal accident, travel and medical insurance cover prior to the tour.
- Price calculation and printing errors. Whilst utmost care is taken, typing and/or printing errors may occur at any time and we retain the right to correct such errors as and when discovered. IBT does not accept any liability for such corrections.
